Terms of Service

Welcome to Yiroo. These Terms of Service ("Terms") govern your use of the Yiroo application, website, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

1. Service Description

Yiroo is a ride-sharing platform that connects riders with drivers in The Gambia. We provide technology that enables users to arrange and schedule transportation services with independent third-party providers of such services.

2. User Accounts

To use our Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. User Conduct

You agree not to use the Service:

• In any way that violates any applicable national or international law or regulation
• To impersonate or attempt to impersonate Yiroo, a Yiroo employee, another user, or any other person
• To engage in any other conduct that restricts or inhibits anyone's use of the Service
• To use the Service in any manner that could disable, overburden, damage, or impair the Service
• To use any robot, spider, or other automatic device to access the Service
• To introduce any viruses, trojan horses, worms, or other material which is malicious or harmful

4. Rider Terms

As a rider using our Service, you acknowledge and agree that:

• You will be charged for rides you book through the Service
• You will treat drivers and other users with respect
• You will not damage drivers' vehicles or property
• You will provide accurate pickup and destination information
• You will be ready at the designated pickup location when your driver arrives
• Cancellation fees may apply if you cancel a ride after a driver has been assigned or if you fail to show up

5. Driver Terms

If you register as a driver on our platform, you acknowledge and agree that:

• You must maintain a valid driver's license and all required permits and authorizations
• Your vehicle must meet our safety and cleanliness standards
• You will maintain appropriate insurance coverage
• You are responsible for all costs associated with your vehicle
• You will follow all traffic laws and drive safely
• You will treat riders with respect and professionalism
• You are an independent contractor, not an employee of Yiroo

6. Payments

Yiroo will facilitate payment for the services provided. Riders agree to pay all fees and applicable taxes associated with the use of the Service. Drivers will receive payment according to the terms set forth in the Driver Agreement.

All payment processing is handled by secure third-party payment processors. By providing your payment information, you authorize us to charge the amount due to the payment method designated in your account.

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Yiroo and its licensors. The Service is protected by copyright, trademark, and other laws of both The Gambia and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Yiroo.

8. Limitation of Liability

In no event shall Yiroo, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use or alteration of your transmissions or content

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of The Gambia, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

12. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service will first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved through negotiation, it shall be submitted to mediation in accordance with the laws of The Gambia.
